新冠疫情下,重新审视设立遗嘱的必要性

在国人的日常话题中,死亡,是一个禁忌。提及死亡,似乎总不太吉利。然而,生命从出生开始,就一定预示着有一天会离去。学会正确地看待死亡,从容地直面死亡,才能帮助我们更好地活好当下生命中的每一天。


新冠疫情当前,越来越多的华人朋友咨询设立遗嘱事宜,大家以一种更客观和理性的视角看待当前的疫情以及对死亡的认知。


立遗嘱是一种死亡教育,更是一种生命教育: 死亡会教会我们敬畏生命、珍惜时光。以更加淡定从容的心态,面对生活中的困难和挫折,以更加感恩的心态,过好生命中的美好时光,毕竟生死之外,都是小事。看开了,也就活明白了。


立遗嘱,是对家人的爱:我们生前立遗嘱,最重要的出发点之一,都是为了活着的家人活得更好、更加幸福。活着不让家人操心,身后事也要让家人省心。


在安省,有遗嘱的,按照遗嘱继承处理;没有设立遗嘱的,按照安省法定继承法(Succession Law Reform Act)规定的法定继承办理。

具体而言,生前立好遗嘱有如下益处:


  • 自主的按照自己的意愿将个人财产予以分配。主动将自己的遗产留给自己所爱的人,留给自己想给的人,而不是被动的听从安省法定继承法的法定分配。简而言之,我的遗产,我做主。


  • 自主指定遗嘱执行人(Estate Trustee)。在遗嘱中,你可以选定值得信赖的某个人或多个人为遗嘱执行人,比如你的配偶、家人、朋友或律师。如未设立遗嘱,按照法律,通常情况下,法庭将从你的家庭成员中指定一人或多人为遗嘱执行人。法庭选择的执行人很有可能不是你真正希望选择的遗嘱执行人,这正是设立遗嘱自主选择的重要性。


  • 自主指定孩子监护人。可怜天下父母心,一个人去世前,可能最惦记,最放心不下的就是自己的幼小孩子。在遗嘱中,你可以选定某个最值得信赖的人为孩子的监护人(临时)。如未设立遗嘱,且父母双方均去世(或有监护权一方去世),则将由法庭决定未成年子女的法定监护人。


  • 立好遗嘱,避免家庭内部继承纷争。
