《禁止非加拿大居民购买住宅法案》解读

禁止非加拿大居民购买住宅法案将于2023年1月1日生效,禁止非加拿大居民在未来两年内在加拿大境内直接或间接购买住宅物业。该法案不影响加拿大公民和永久居民。对某些人群、住宅物业类型和特殊情况有所豁免。


谁被禁购?

法案对非加拿大居民定义如下:

(a) 个人:非加拿大公民,非登记原住民,非永久居民;

(b)公司:非依据加拿大联邦或省管辖法律设立公司;

(c)根据加拿大联邦或省管辖法律设立公司,其股票未在根据《所得税法》第262条的指定加拿大证券交易所上市,且由上述(a)或(b)所述的个人或公司控制;

(d)法令指定的个人或实体。


哪些住宅被禁购?

法案对禁购住宅物业定义如下:

住宅物业是指除法案条例规定的不动产外,位于加拿大境内的以下不动产:

(a)独立屋或类似建筑物(不超过三个住宅单元)

(b)半独立式住宅、联排住宅单元、住宅共管公寓单元或类似建筑物;

(c)本法定规定的其余不动产。

注解:四个及更多单元的独立屋或类似建筑物不受本法案管辖。


谁可豁免?

”豁免人群:

(a) 符合本法案细则规定条件的《移民和难民保护法》中定义的临时居民(学签和工签持有者)。

(b) 《移民和难民保护法》中定义的难民。

(c)非加拿大居民与其配偶或同居伴侣在加拿大共同购买住宅物业(要求其配偶或同居伴侣需为加拿大公民、《印第安人法》登记的原住民、永久居民或上述(a)或(b)项所述之人)

(d)本法案细则规定的人群类别。


学签持有者豁免条件如下:

a. 就读于《移民和难民保护法》条例中定义的特定教育机构/学校

b. 买房之前5年间每年申报个人所得税;

c. 买房之前5年每年在加拿大住满244天

d. 所购买的房产价格不得超过50万加币

e. 未曾购买过多于一套的住宅物业。


工签持有者豁免条件如下:

a.持有有效工签,或者根据《移民法》条例第186条准许在加拿大工作

b.买房之前四年中,至少有三年全职工作

c.买房之前四年中,至少有三年申报个人所得税

d. 未曾购买过多于一套的住宅物业。


违反禁购法的处罚

本法案规定,任何非加拿大居民,以及任何其他人明知却仍然指导、诱导、帮助或教唆非加拿大居民在加拿大购买住宅物业,即构成违法行为,面临不超过10,000加元的罚款。


如公司或实体违反禁购法案,违法购买禁购住宅物业,则以下指导、授权、同意、默许或参与违法行为的相关人员同样面临处罚:

(a)公司或实体的管理人员、董事或代理人;

(b)公司或实体的高管;

(c)被授权代表公司或实体行使管理或监督职能的任何个人。


违法惩罚总结:

a. 违法购房者处最高罚金$10,000

b. 法院可判令购买者卖房,违法者卖房收益不得超过购入价。

c. 有关参与诱导,协助违法购房者促成交易的第三方都将受到处罚。


对生效前既有合同的影响

法不溯及既往,本禁购方案将于2023年1月1日实施。对于在2023年1月1日前签署的购房合约(包括转让购房合约)不受本法案禁止。
