Fam013 在中国的离婚判决,能否得到加拿大法庭的承认?

根据加拿大联邦离婚法案(Divorce Act)第22条的规定,对外国法院的离婚判决,在满足以下管辖权条件下,在加拿大通常是被承认的:

1. 离婚任一方在外国离婚诉讼立案前在该国常住至少一年;

2. 离婚任一方与该外国具有真实实质性的联系。


法庭通过以下因素来判定当事人与外国是否具有真实实质性联系:

1. 居住;

2. 就业;

3. 是否为该国国籍?

4. 是否在该国拥有资产,不动产?

5. 是否为出生地?

6. 是否在该国结婚?

移民加拿大的华人即使不能满足离婚诉讼前在中国常住一年的时间限制,也通常能够满足离婚任一方与中国具有真实实质性联系的条件,从而在中国的离婚判决,通常而言,是能够得到加拿大法庭的承认。


哪些离婚判决不会被认可

尽管加拿大法庭不会对于他国法庭的离婚判决进行实质性审查,比如他国法庭是否按照该国的法律予以判决(本质上相当于对于他国的判决再次审判一次),但是加拿大法庭会对他国的离婚判决进行程序性审查。如存在以下情况,该外国离婚判决将不予承认:

1.判决尚未发生法律效力;

2.作出判决的外国法院案件没有管辖权;

3.判决违背了自然公正(Denial of natural Justice),比如是在被告缺席且未得到合法传唤或送达的情况下作出的;

4.离婚判决存在欺诈;

5.判决违反加拿大社会公共利益(Public Policy)。


在中国离婚后,如何在加拿大再婚

在中国离婚的一方,如在加拿大再婚,需要先获得安省政府颁发的授权令(authorization),才能申请结婚许可证。


如何申领安省授权令(authorization)

1. 结婚双方签署的结婚许可证申请表;

2. 加拿大以外的其他国家颁发的离婚证或法院离婚判决原件;如证件或文件使用语言非英文或法文,需提供翻译件以及翻译员的宣誓证词;

3. 结婚双方签署的全权责任声明书;

4. 安省注册律师出具的法律意见书。
