RE03 购买新房需要知道的HST退税事宜

大家都知道在安省,HST税率是13%。其实这个13%的税率是由两部分构成的:联邦的5% Goods and Services Tax (GST) 和安省的8%的 Retail Sales Tax (RST)。


不同于住宅二手房交易(免交HST),买新房要缴纳13%的HST。


作为政策鼓励,无论新房用途为自住或出租,均有HST退税需要指出的是,退税退回的仅是缴纳HST的一部分,不是全部。


HST退税有多少?

退税由两部分构成:联邦和安省:

联邦退税 (所付的GST x 36%):

  • 房价在35万及以下的,联邦退税= 房价* 5% * 36%。按照35万算,最高退税额为$6300。

  • 房价在35万到45万之间的,联邦退税随着房价上升而直线递减。具体而言,联邦退税率由35万时的36%直线递减到45万时的0%。 文字理解起来比较困难,华人的数学都很好,用下边的公式理解起来更容易一些。联邦退税=($450000–房价)/100000 * 6300;

  • 房价超过45万,就没有联邦退税了。


安省退税(所付的PST x 75%):

  • 房价低于40万时,安省退税= 房价*8%*75%。按照40万算, 安省最高退税额为$24,000。

  • 房价超过40万,退税额为最高限额$24,000。


如何申请HST退税?

  • 自住:通常情况下,买家无需自己申请,因为开发商会向国税局代为申请自住房的HST退税。新房购房合同通常都会写明买家将HST退税转让给开发商,合同价款已包含了HST退税。为什么要这么做的?其目的是为了使成交价格看起来较低,具有市场竞争力。需要说明的是,自住买家在交房日要向开发商提供承诺书,承诺新房用途为自住,并且承诺如国税局拒绝HST退税申请,则买家赔偿开发商退税金额。

  • 出租:开发商不代办申请退税,交房时买家缴纳13%HST,而后买家(房东)应在开发商交房日2年内申请退税。
