对于家庭财产分割,您与您的配偶必须做的第一件事是夫妻双方必须准备并向对方披露一份完整的财务报告,包括你们全部的资产、债务及收入。你们必须宣誓此财务报告真实准确。在此基础上,根据法律规定,分别计算出你们各自在家庭财产中所占份额的总价值。


您可以利用以下1-4 步骤来计算您在家庭财产中的份额:

第一步:计算出您在分居当日您拥有财产的价值

  • 您的财产是在您名下或者属于您的任何东西。

  • 您必须列出您所有的财产,包括在本国或在世界其它地方的财产。例如,您的财产清单可以包括您的住宅、生意(公司)、汽车、家具、音响设备,衣服,运动器材,珠宝,银行账户上的存款及退休金计划的储蓄等,以及您有权获得的退休金,甚至是您从现在起几年后才能获得的退休金。

  • 如果你们拥有一些联名财产,你们每人应把每项财产价值的一半列入自己的清单。


第二步:减去你们分居时所欠的所有债务价值

  • 所有债务,包括如信用卡欠款、房屋贷款以及汽车贷款之未清偿的部分。

  • 列出这些债务在分居日的价值。


第三步:减去法律允许您自己保留的财产价值

  • 这些财产包括在婚姻期间您收到的、但不是由您配偶赠送的礼物及遗产、因某人去世您自保险公司获得的金钱,以及您获得的、或有权获得的人身伤害赔偿金。


第四步:减去您带入婚姻的财产价值(扣除债务价值)

  • 合计您结婚时拥有的所有财产的价值总额。

  • 不要将家庭住宅包括在内,即便您在结婚日时就已经拥有它了。

  • 减去您结婚时所有的债务。

最后一步将让您知道,你们其中一人是否欠对方任何钱。

第五步:找出是否有应付款项

  • 将您所占家庭财产的份额与您配偶的份额相比较。

  • 用较大数额减去较小的数额

  • 将差额除以 2。这就是拥有较大份额的配偶必须支付给拥有较少份额配偶的款项。

  • 这一款项被称为均等付款(Equalizing Payment)

注意:如果一个人的债务多于财产,则他或她的家庭财产份额价值为零。例如,如果你们分居时您欠银行 $15,000,而且您的财产价值只有 $8,000,那么为了计算出均等付款,您的家庭财产价值为$0。


实例

一对夫妻H和W决定分居。在结婚之日,H拥有一辆汽车价值$5,000, 学生贷款$10,000以及信用卡债务$5,000。在结婚之日,W的资产包括婚前不久刚刚获得的家庭遗赠$4,000。在分居日(评估日), H拥有银行存款$20,000 (包括婚姻期间家庭遗赠获得$5,000)。H还清了全部学生贷款。W的RRSP 账户拥有$50,000。 H和W共同拥有在婚姻期间购置的家庭住宅价值$400,000。此外夫妻有共同债务$10,000。


第一步: 计算双方各自在分居当日拥有财产的价值

H: $20,000 (银行存款) + $200,000 (家庭住宅价值的50%份额)= $220,000

W: $50,000(RRSP)+ $200,000 (家庭住宅价值的50%份额)= $250,000


第二步: 减去分居时您欠的所有债务

H: $220,000 - $5,000 (共同债务的50%份额)= $215,000

W: $250,000 - $5,000 (共同债务的50%份额)= $245,000


第三步: 减去法律允许您自己保留的财产价值

H: $215,000 - $5,000 (婚姻期间家庭遗赠)= $210,000

W: $245,000 - $0 (无符合法律规定的除外财产)= $245,000


第四步: 减去您带入婚姻的财产价值(扣除债务)

H: $210,000 - ($5,000 汽车价值 - $10,000 学生贷款 - $5,000 信用卡债务)= $210,000 - (- $10,000 婚前财产价值)= $220,000

W: $245,000 - ($4,000 婚前家庭遗赠 - $0 债务)= $245,000 - ($4,000 婚前财产价值)= $241,000


第五步: 查明是否有应付款项

H的净家庭财产 (Net Family Property, NFP) 是$220,000

W的净家庭财产 (Net Family Property, NFP) 是$241,000

W的净家庭财产多于H的净家庭财产, 其差值为$241,000 - $220,000 = $21,000

均等付款(Equalization payment)为$21,000 ÷ 2 = $10,500

这样,W必须支付给H $10,500 的均等付款。
