在加拿大安省,法庭关于抚养费和赡养费判决都会自动登记在录在家庭责任办公室(Family Responsibility Office, FRO)。如果抚养/赡养费安排出现在家庭契约(婚姻契约、分居协议或同居协议)中,而不是法庭判决,您仍可以向FRO申请将家庭契约在FRO 登记在册。

FRO 专门处理子女抚养费和配偶赡养费事宜,以确保抚养费/赡养费的按期支付。 如支付方不按时支付或不全额支付,则FRO 会采取相应措施,以强制执行抚养/赡养判决。FRO对于强制执行抚养/赡养判决具有专属权,换言之,抚养/赡养判决在FRO登记在录后,抚养/赡养费接受方不可单独采取其他强制执行行为。


抚养/赡养费自动扣减

当法庭判决一方支付定期的抚养/赡养费时,法庭也会颁发赡养费扣减令(Support Deduction Order)。法庭向FRO 发送赡养费扣减令,FRO 写信通知支付方的雇主(或其它收入来源),要求雇主从薪金中扣减抚养/赡养费金额,并将这笔钱直接转至FRO。然后FRO 再根据法庭判决将抚养/赡养费转给接受方。


退出 FRO

如果支付人(Payor)和接受人(Recipient)都自愿同意退出FRO,则他们可以将经双方签字的退出通知书寄送FRO。FRO 接到通知书后会结案处理。可是,如果接受人正在接受社会救济,并且赡养令已经转给社会民政机构,则提供社会民政机构也要同意从FRO 收回赡养令。如果您想退出FRO, 您应该先确认赡养判决是否已转给社会民政机构,且是否需要获得其同意。您可以发送转让确认书(Confirmation of Assignment)给社会民政机构来确认此事。

如果支付人没有遵守赡养令并拖欠赡养费,则接受人可单方退出FRO, 并单独采取行动,强制执行赡养令。同样,FRO 收到此通知后会结案处理。如果接受人正在接受社会救济,且赡养令已转让给社会民政机构,则社会民政机构必须同意退出FRO 。

如果您已经从FRO 退出,日后遇到赡养费问题再次寻求FRO 帮助,您可以再次将赡养令、家庭契约在FRO 备案登记,但是支付人和接受人要支付一定的管理费用。


如何强制执行?

如果您退出FRO或家庭契约未在FRO登记在册, 如支付方未能按时或全额支付赡养费,接受方可采取如下方式追缴拖欠的赡养费:

• 申请违约听证,在这种情况下,支付人必须向法官解释为什么没有支付赡养费。如果法官对其解释不满意,则可判决其支付赡养费。在极特殊的情况下,甚至将违约支付人送进监狱;

• 如果雇主不服从或忽视扣减令,则将扣押支付人的工资,并将支付人的雇主传唤到法庭;

• 查封支付人的银行账户;

• 查封支付人的注册退休储蓄计划(RRSP);

• 将赡养令注册在支付人的房屋、其它不动产或个人财产上;

采取这些法律行动费时又耗费钱财,而且您可能还需要一位律师来帮助您。其实您不必自己去强制执行赡养令,通过FRO 替您追缴应得的赡养费,何乐而不为呢。


FRO 可以采取以上所有步骤帮您追缴赡养费,除此之外,FRO 还可以:

• 从任何个人或公共团体索取支付人的就业、财务状况和地址等相关信息;

• 从联邦政府欠支付人的款项中扣减(包括所得税退税和就业保险金);

• 向信用局报告支付人所欠赡养费的数额;

• 如果奖金额超过 $1,000,且在安大略省内抽奖,可扣押支付人的彩票奖金;

• 暂停支付人使用驾驶执照的资格;

• 暂停支付人使用联邦许可证或特权,例如飞行员驾照或加拿大护照的资格。
