公证01 什么是三级认证?办理种类及过程?

经常有客户询问有关三级认证的问题,在此总结三级认证的目的、常规办理种类,及办理过程。


根据中国《领事认证办法》规定,办理三级认证的目的是使其他国家(比如加拿大)出具的公证书等公证文件能在中国境内被关部门承认并且具有法律效力,不致因怀疑文书上的印章和签字是否属实而影响文书的法律效力。

通常来讲,客户办理三级认证的文件有以下几种:

1.单身/无配偶声明认证(在中国结婚或转让房产);

2.授权书(转让房产,注销户口,或做无犯罪证明等);

3.侨眷证明(侨眷子女高考加分);

4.寄养委托书(寄养子女与在中国的亲属生活);

5.身份核实(入加拿大国籍后,证明旧中国护照的中文名字与新加拿大护照的英文名字为同一人);

6.遗产放弃声明;

7.各种文件(加拿大护照,公民卡,离婚证,结婚证或出生证等)作核证副本。


办理程序

第一步:公证文件

有关文书应当首先由当地律师、公证员(Public Notary)或监誓员(Commissioner of Oaths)办妥公证。


第二步:加国外交部或安省政府认证

拿着第一步办好的公证书到加国外交部或安省政府做认证。


第三步:中国使领馆认证

拿着第二步办好的认证文件到中国使领馆办理最后一步,中国使领馆的认证。办理时间通常3到4 个工作日。此步骤,在客户授权代理的情况下,我们可以代办。我们可以也可以按照客户的需要在办好的文书直接邮寄回中国。
