公证02 三级认证常见问题解答

(1)旅居加拿大的李先生加入加拿大国籍,因中国不承认双重国籍,故中国护照作废,中国户口及身份证被注销。但是李先生在国内银行仍有账户或国内房产需要出售,国内相关机构需要核实李先生身份,应如何办理?

答:李先生可联系新起点律师事务所,办理身份核实(中国护照中文名字与加拿大护照英文名字为同一人)公证。之后办理本地认证,最后到中国驻外使领馆办理领事认证。


(2)中国公民李先生欲为其出生在加拿大的孩子在中国内地办理户口手续,中国内地公安机关要求其出示经我驻外使领馆认证的孩子出生证明,应如何办理?

答:李先生可联络新起点律师事务所,办理孩子出生证明公证。之后办理本地认证,最后到中国驻外使领馆办理领事认证。


(3)渥太华本地出具的死亡证明如何办理三级认证?

答:无论死者是否为中国公民,如果有关死亡证明需送至中国境内使用,请联系新起点律师事务所办理本地公证。之后办理本地认证,最后到中国驻外使领馆办理领事认证。


(4)旅居加拿大的中国公民李某和张某在当地办理结婚手续后,因准备在中国内地购买房产,询问其结婚证可否直接在中国内地使用?

答:中国公民在加拿大依法办理的结婚证,不可直接在中国内地使用。当事人应先联系新起点律师事务所办理结婚证的公证。 之后办理本地认证,最后到中国驻外使领馆办理领事认证。三级认证后,该结婚证方可在中国内地使用。


(5)旅居加拿大的华侨李先生回国结婚时,应当办理何种公证?

答:根据中国的《婚姻登记条例》规定,华侨在国内婚姻登记机关办理婚姻登记应当提供本人无配偶的证明。故李先生可联系新起点律师事务所办理单身无配偶声明书公证。之后办理本地认证,最后到中国驻外使领馆办理领事认证。


(6)李先生,中国公民,想在中国国内购买房产,但本人无法回国,如何办理委托书公证?

答:委托书公证的意义在于,在当事人身在国外,不便亲自办理有关手续时,可以把相关事务委托给他人,并通过办理公证,对该委托行为的真实性、合法性予以证明;受托人办理相关事宜时,向国内有关部门出示经公证的委托书。

李先生可联络新起点律师事务所,办理委托书公证。之后办理本地认证,最后到中国驻外使领馆办理领事认证。此外,李先生亦可到中国驻外使领馆申办委托书公证。


(7)李先生,加国华侨,其子女在国内上学参加国内高考,应如何办理相关公证,以便其子女获得高考加分?

答:按照国内相关政策,“三侨子女”在国内参加高考可获得10分加分。对于高考考生,每一分都弥足珍贵,更何况是10分。在国内办理华侨身份认定时需提供居留证明。需要注意的是,居留证明公证仅作为对居留事实的认定,而对华侨身份的最终认定由国内侨务部门负责。

(8)李先生,为旅居加拿大的中国公民,在当地大学毕业并取得毕业证书,想在中国境内谋职,该毕业证书如何办理三级认证?

答:李先生可联系新起点律师事务所,办理加国毕业证书公证。之后办理本地认证,最后到中国驻外使领馆办理领事认证。此外,亦可回国后在国内办理教育部留学服务中心的学历认证。
