新冠疫情时期中加跨境法律文书的公证和使馆认证流程介绍

天有不测风云,2020新冠疫情席卷全球。截至目前,中国和加拿大均对入境做出严格限制,入境需强制隔离,同时中加航班或暂停或大大削减,加之跨国飞行具有较大感染风险,所以很多华人朋友被迫搁置出行计划。但与此同时,这些华人朋友在中国还有房产、股票等财产需要处理,或者涉及例如退休金办理,父母遗产继承等其他事务,回国亲自办理已不现实或存在诸多不便。那该怎么办?这些华人朋友可以通过办理授权委托书的方式予以解决。

在疫情日益严重的特殊时期,咨询中加跨境法律文书公证以及认证的客户越来越多,故在此对大家经常问道的一些问题予以解答。

1. 三级公证认证的目的

根据中国《领事认证办法》,领事认证是指领事认证机构根据自然人、法人或其他组织的申请,对国内涉外公证书、其他证明文书或国外有关文书上最后一个印鉴、签名的真实性予以确认的活动。领事认证的目的是使一国出具的文书能在其他国家境内得以承认,不会因怀疑文书上的印鉴、签名的真实性而影响其域外法律效力。

2. 常见三级公证认证文件种类

通常来讲,客户办理三级认证的文件有以下几种:

  • 授权委托书(出售房产,注销户口,或做无犯罪证明等)

  • 单身/无配偶声明认证(在中国结婚或转让房产);

  • 侨眷证明(侨眷子女高考加分);

  • 寄养委托书(寄养子女与在中国的亲属生活);

  • 身份核实(入加拿大国籍后,证明旧中国护照的中文名字与新加拿大护照的英文名字为同一人);

  • 遗产放弃声明;

  • 各种文件(加拿大护照,公民卡,离婚证,结婚证或出生证等)作核证副本。

3. 三级公证认证办理流程

第一步:公证文件

有关文书应当首先由当地律师、公证员(Public Notary)或监誓员(Commissioner of Oaths)办妥公证。

第二步:加拿大外交部认证

拿着第一步办好的公证书到加拿大外交部做认证。由于疫情严重,目前加拿大使馆认证中心只接受邮寄办理。具体邮寄办法请查询政府网站相关内容:https://www.international.gc.ca/gac-amc/about-a_propos/services/authentication-authentification/step-etape-4.aspx?lang=eng#a3

第三步:中国使领馆认证

拿着第二步办好的认证文件到中国使领馆办理最后一步,中国使领馆的认证。办理时间通常3到4 个工作日。如果您是加拿大国籍,必须到签证中心办理。

4. 中加跨境法律文书准备注意事项

因为法律文书将在中国使用,而国内各部门、机构对文件格式及内容通常有不同要求。如果文书内容不符合使用机关的要求,则国内办理机构会不认可公证认证文件。 为避免上述风险,我们建议客户先联系国内相关部门或机构,请之提供文书格式及内容。或将法律文书拟稿发至国内办事机构予以确认。
